Currently many are evading fines because there has to be a criminal burden of proof against them, and that is too expensive.... plus fines are currently too small to make a difference.
The plan is to introduce a lower level of proof needed and automatic penalties, with clarity about when they might be imposed.
There's a lot of reading in the consultation, but it gets repetitive and the questions themselves mostly just require yes and no answers.
The deadline for responding is 3rd December 2025.
